Family immigration includes petitions by US Citizen or Lawful Permanent Residents (LPR) for select family members, including spouses, children, parents, and siblings. A US Citizen or LPR family member can file a family petition for these individuals, who could then be eligible to apply for residency themselves.
Certain individuals may be eligible to apply for a visa or for residency as a result of being victims of certain crimes or persecution. This includes victims of qualifying violent crimes (U Visas), human trafficking (T Visas), domestic violence (VAWA), or persecution as a result of their race, religion, national origin, or membership in a particular social group (Asylum).
Noncitizens who have been charged with immigration violations may be required to appear in front of an Immigration Judge. Any applications for relief will need to be submitted to and reviewed by the Judge. The Judge will make a determination as to whether or not that noncitizen should be permitted to remain in the United States, or if they should be ordered removed.
